International Arrangements

Convention priority can be claimed, but priority claims have no effect on the filing of the application under the current legislation.
The priority date will be reflected on the certificate of registration, so as to indicate that the mark was 'registered' earlier.

Renewal

7 years from the filing date, and every 10 years thereafter.

No grace period is specified under the Trade Marks Act, and marks may be removed from the Trade Marks register 1 month after the date of their non-renewal.  That being said, it is possible to apply for restoration of rights so lost, upon payment of the corresponding fees.

Use Provisions

Non-use of a trade mark for a period of 5 years from registration renders the mark vulnerable to an action for cancellation by third parties.

Substantive with or without priority claims.
Designation in ARIPO patent.
PCT national phase or via designation in ARIPO regional phase application.

We have been informed that, whilst a statutory instrument was passed towards the commencement of the Industrial Property Act, 2014, the Act is still without regulations and fee regulations to operationalise it.  However, the Director of the IPO has intimated that the Act is in force, notwithstanding that we wait for the regulations to pass.
