Use Provisions

In order to avoid cancellation of the registration, an Affidavit of Use/Non-Use must be submitted to the Cambodian Trademark Registry within one year following the 5th anniversary of the registration date.

Black-box applications for pharmaceutical products - these will be held in abeyance until the protection of pharmaceutical products commences in 2033.

In addition, on 23rd January 2017, the Cambodian government signed an agreement with the European Patent Office (EPO), which will allow applicants to extend their European patent rights to Cambodia.  The agreement was predicted to enter into effect on 1 July 2017, by when relevant changes in Cambodian national law will have been made to accommodate it, but we are still awaiting confirmation of this.

Duration

Patents are granted for a term of 20 years from the effective filing date.

Renewal

Renewal fees are payable on the first and each subsequent anniversary of the filing date.  

The Patent Office has verbally stated that is it postponing annuity payments for all pharmaceutical-related applications, because of the pending amendment to the local law prohibiting the registration of patents for pharmaceutical-related products until 2033.

A design registration is valid for a period of five years from the date of filing, renewable for two consecutive five year periods, subject to the payment of renewal fees.

Renewal

Renewal fees are payable on the 5th and 10th anniversaries of the filing date.
